New Data Protection Act

Swiss regulations on the protection of personal data are undergoing a major change, which has resulted in the General Regulation and the New Data Protection Act (nLPD) of 1 September 2023.

Our company, committed to complying with regulations that improve relations with our European customers, has ensured compliance and expresses in this charter its commitment to providing quality service to our customers, whether they are individuals or professionals.

This new regulation concerning European citizens who are not professionals, and therefore considered «individuals», strengthens citizens' control over the use of their data. The regulation applies to all processing of personal data, whether automated or non-automated, whether or not the data is contained or intended to be included in a file.

What constitutes personal data for an individual?

By definition, personal data is: «Any information relating to a natural person identified directly (surname, first name) or indirectly (by an identifier, customer number, telephone number, etc.). A natural person can be identified from a single piece of data (ABS number, SS number) or from a combination of data sets.

What personal data may we collect?

We only collect data that is adequate and relevant, strictly limited to the provision of the service you have ordered and, with your consent, data relating to our commercial and marketing activities.

Why do we need to collect and process your personal data?

Your personal data is collected and processed to enable us to conclude, manage, modify and perform the service you have ordered and, with your consent, to inform you about the services and products you can benefit from at Terra-Beka Lodge.

Who do we share your personal data with?

Your personal data is intended for Terra-Beka Lodge employees according to their role and for some of our subcontractors. All members of our staff have been trained and comply with the nLPD. Our subcontractors also comply with the requirements of the nLPD in order to ensure the proper performance of the service ordered. None of the information collected is transferred or sold to any third party that is not a recognised subcontractor. The data is hosted exclusively in Switzerland and Europe.

How long do we keep your personal data?

Personal data collected and processed in connection with a service ordered, commercial contact or sales follow-up is retained in accordance with the statutory limitation periods set according to the nature of the contract and in compliance with Swiss regulations, i.e. for 10 years. In the context of commercial prospecting, personal data is retained for 2 years from the date of collection or the last contact with the data subject. The data is then anonymised in order to preserve the basis for the company's statistical studies.

What security measures are in place to transport your data?

In accordance with the applicable General Data Protection Regulation, you have various rights, namely:

  • Right of access: you may obtain information concerning the processing of your personal data and a copy of this personal data.
  • Right to rectification: if you believe that your personal data is inaccurate or incomplete, you may request that this personal data be amended accordingly.
  • Right to erasure: you may request the erasure of your personal data within the limits permitted by the regulations.
  • Right to restriction of processing: you may request that the processing of your personal data be restricted.
  • Right to object: you may object to the processing of your personal data on grounds relating to your particular situation. You have the absolute right to object to the processing of your personal data for commercial prospecting purposes, including profiling related to such prospecting.
  • Right to define guidelines regarding the storage, deletion or disclosure of your personal data, applicable after your death.
  • Right to withdraw consent: if you have given your consent to the processing of your personal data, you have the right to withdraw your consent at any time.
